Cpstcpasettlement com Reviews – Is Scam or Legit Website? A class action is a lawsuit in which the rights and claims of several men and women are determined in one court proceeding. Representative plaintiffs, also called”Class Representatives,” assert claims on behalf of the whole class.

The Class Representatives registered or filed this lawsuit alleging that Cavalry is accountable under the Telephone Consumer Protection Act (the”TCPA”) for calls it created to mobile phones while trying to amass using what Plaintiffs assert are automatic telephone dialing systems, the Aspect Ensemble Guru system, or even the Avaya Proactive Contact 5.0 program, without permission.

Cavalry denies it violated the TCPA and specifically denies that it used an automated phone dialing system to phone any type member without prior express permission.

What does the Settlement provide?

Cavalry has agreed to establish a Debt Relief Fund up to $18,000,000, and Also to Set a Cash Fund of $6,150,000.

In case you’ve got an Open Account with Cavalry, you can maintain a pro-rata talk of debt relief up to $599 or maintain that a pro-rata share in the Cash Fund. You can maintain debt relief or money but not both. In case you’ve got a Closed Account with Cavalry, you can maintain a pro-rata share in the Cash Fund although not debt relief. The Cash Fund is also utilized to pay Class Counsel’s attorneys’ fees and costs, cover incentive awards to the Class Representatives, and cover expenses and costs of compensation management. Any residual monies from uncashed checks could be redistributed in a further distribution to legitimate claimants.

Am I a Class Member?

You’re in the Settlement Class in case you’re called by Cavalry onto a mobile phone while it was trying to accumulate with the Aspect Ensemble Professional or the Avaya Proactive Contact 5.0 dialing systems between February 8, 2009, and January 26, 2016. Excluded from the Class are those that are not or weren’t ordinary subscribers or users of mobile phones connected with the 1,035,232 Open and Closed Accounts, are directors or officers of Cavalry or any Cavalry affiliate, any justice, judge, or magistrate judge of the USA or any State, their spouses, and individuals within the third degree of relationship to either of these, or the spouses of these persons, and also all men that validly exclude themselves or select out of the Settlement Class. 


Submit a Claim FormThis is the only way to get debt relief or a cash award. You can submit a claim form online here or by mail. If you fail to submit a claim, you will not receive a settlement payment. Class Members who submit a claim give up their rights to sue the Defendant about the claims in this Litigation.

Exclude Yourself or “Opt Out” of the SettlementIf you are a Class Member and exclude yourself, you will not be included in the Settlement.
