An accident killing one MSU student and injuring another back in 2007 resurfaces as a civil lawsuit is filed.News 12's Jennifer Hudspeth joins us in the newsroom with new details about the case.Dion, Nicole....Corinne Overstake is suing Jesse Mann, and his father for the accident that happened back in November of 2007.Overstake and 22 year old Rissa Amen-Reif had left a sorority event earlier that night when they were struck on Third Avenue.Police say Amen-Reif was lying in the road, and Overstake was trying to help her.Amen Reif was killed, Overstake survived although her injuries were critical.Now Overstake is suing Jesse Mann and his father Arland Mann... the owner of the Toyota Tercel he was driving.Overstake's attorney says his client had more than 80 thousand dollars worth of medical bills after the accident.Nygaard says, "It was a tragic accident, but accidents are preventable and when you hit a lady who was running to assist someone else who has fallen down in the street and she's run over and that person should have been illuminated by your headlights and should have been in plain view, then in fact it's our position in this case that he was negligent and his company should be responsible for the damages caused by his behavior."Jesse Mann's attorney says a thorough investigation by State Patrol proves his client was not the cause of the accident.White says, "They found that there was nothing he could have done differently to avoid the accident and as a result found he was not responsible for the accident...it is as I said before just a tragic accident."Attorneys for both sides have tried to negotiate but have not been able to reach a compromise, which most likely means the case will go to trial.The lawsuit was first filed in Hennepin County but has since been moved to Blue Earth County.Overstake is suing for a minimum of 50 thousand dollars.In the newsroom, Jennifer Hudspeth News 12.
