Attorney Disputes Evidence in Rape Case

A Mankato man charged with four felony counts for allegedly raping a North Mankato woman was in court Wednesday disputing evidence against him. According to the criminal complaint, John Thomas, 45, forced himself into the North Mankato woman's home and assaulted her.

The Wednesday defense made two legal challenges. The first involved the admissibility of Thomas' statements made to authorities after the alleged incident. The second legal maneuver involves reliability and the chain-of-custody of DNA evidence gathered.

James Dunn, Nicollet County Prosecutor, says, "The witnesses testified that they acted in accordance to their protocols both in the collection and preservation of the DNA evidence and that the defendant provided a statement to law enforcement after he had been advised of his rights."

Thomas is back in court tomorrow. Prosecutors say they plan to call more witnesses during the upcoming hearing.
