Gun Charges for 12-Year-Old Challenged at City Council Meeting

NORTH MANKATO, Minn. -

Dyllon Johnston of North Mankato is currently facing charges for illegally discharging a firearm on August 16th.
 
The catch - he's twelve. And it was an airsoft gun. 
 
Flanked by two-dozen supporters, Michael Johnston, father of Dyllon, asked the North Mankato City Council to change the city ordinance he son is charged with violating.

The ordinance for discharging firearms includes compressed gas or mechanical springs, which Johnston says could include a host of toys used by many children.
 
Michael Johnston says, "You're now condemning a child for being a 12-year-old child. And that needs to be looked at immediately, because there's kids all over doing the same thing."

The issue managed to bring out plenty of supporters, and the council started to think about addressing the issue, though North Mankato City Attorney Michael Kennedy advised them not too because of the confidential nature of juvenile crime, saying instead that the ordinance could be brought up for review.
 
North Mankato City Attorney Michael Kennedy says, "It may be that in this particular case the definition of what we define as being impermissible in North Mankato - some judge will decided whether or not that includes the gun we saw in the newspaper. The toy we saw in the newspaper. The judge may say it doesn't include that. But the bottom line is that we as a government body have to make decisions."

Johnston decided not to take a diversion offer from Nicollet County, worried that even that minor blemish could affect his son's prospects with military academies in the future.
